2. Acceptance of Terms of Use

   By accessing this website, you declare that you have read, understood and accepted the Terms of Use described below without further consent.

3. Copyright

   Text, images, graphics, downloads, sounds, videos, animation, and all other information represented on the website may not be copied, distributed, modified or posted on other websites without the prior written permission of MadeiraSurreal.com.

4. Links to third party pages

   MadeiraSurreal.com may provide links to third party pages on its website. Since these sites are not owned or operated or controlled by MadeiraSurreal.com, we are therefore not responsible for their content.

5. Communications

   All communications will be sent to the person named on the Booking form using the email address supplied unless you specify otherwise.

6. Amendments by MadeiraSurreal.com

   We make every effort to ensure that the information and descriptions on our website are accurate. However, errors may occasionally occur, and we reserve the right to correct any mistakes or update information before confirming your booking. If, after your tour has started, we are unable to continue providing the service due to unforeseen circumstances, we will make suitable alternative arrangements at no additional cost whenever possible. If no suitable alternative can be provided, we will return you to your original departure point and refund the unused portion of your tour.

7. Exclusion of Liability

   We make every effort to ensure that the information on this website is accurate and up to date. However, we cannot guarantee that it is free from errors, omissions, or inaccuracies, and the content may be updated or changed at any time without prior notice. To the fullest extent permitted by law, MadeiraSurreal.com accepts no liability for any loss or damage arising from the use of, or inability to use, this website.

8. Governing Law

   These Terms and Conditions are governed by the laws of Portugal. Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the Portuguese courts.

9. Cancellation by us

   We may need to change or cancel a tour if a red weather alert is issued by the local authorities or due to circumstances beyond our control (force majeure). This includes events such as severe weather, natural disasters, transport or equipment failures, power outages, strikes, civil unrest, or other unforeseen situations that make the tour unsafe or impossible to operate. If this happens, you will be offered either an alternative date for the same tour or a full refund.

10. Cancellation by you

    • 7 days or more before the tour: Full refund.
    • 2–6 days before the tour: 90% refund (10% administration fee).
    • Less than 48 hours before the tour: No refund.
    • No-shows or cancellations after the tour has started: No refund.

    All cancellation requests must be made by the person who made the booking, by phone or email.

11. Cruise Ship Guests

    Guests arriving by cruise ship are responsible for ensuring they return to the ship before its scheduled departure. While we make every effort to operate our tours on schedule, MadeiraSurreal.com cannot be held responsible for missed cruise departures resulting from delays or circumstances beyond our reasonable control.

12. Insurance

    MadeiraSurreal.com has insurance cover as required by portuguese law in order to operate a business of this nature. All passengers are insured.

13. Currency & Taxes

    All prices are quoted in Euros and include all taxes.

14. Code of Conduct

    By completing your booking, you agree to follow the instructions and decisions of the driver or guide throughout the tour. To ensure the safety and enjoyment of all participants, we reserve the right to refuse or terminate the participation of any guest whose behaviour is considered disruptive, unsafe, or inappropriate. In such cases, no refund will be provided.

15. Acceptance of Risk

    All tours are led by a professional driver/guide with the appropriate training and experience. By booking a tour, you acknowledge and accept the inherent risks associated with participating in driving activities. These may include physical exertion, changing weather conditions, limited access to medical services, and delays in emergency assistance due to remote locations. You also understand that routes, itineraries, schedules, or vehicles may need to be changed without prior notice due to circumstances beyond our control, including adverse weather, road closures, mechanical issues, illness, strikes, local events, or other unforeseen situations.

16. Children under the age of 16

    Children under the age of 16 remain the sole responsibility of their parent or legal guardian throughout the tour. They must be accompanied and supervised at all times and may not be left unattended or in the care of other guests or the driver/guide. In accordance with Portuguese law, children under 12 years of age who are less than 135 cm (4 ft 5 in) tall must use an appropriate child restraint system. Child seats are available free of charge upon request at the time of booking, or you may provide your own.

17. Pickup and drop-off

    The price shown at the time of booking includes pickup and drop-off within Funchal city.

    We offer complimentary pickup and drop-off from your hotel, accommodation, the harbour, or any other address within the city limits of Funchal.

    For locations outside Funchal, a surcharge of 2,00 € per kilometre, per vehicle may apply, based on the distance from Funchal. For example, if your accommodation is 10 km away, the additional charge will be 20,00 €. Any surcharge is payable directly to the guide on the day of your tour. Alternatively, you may arrange your own transportation to a meeting point in Funchal to avoid the extra charge.
